The parents of two Fayette County children who were reported dead inside their home March 11 were indicted Wednesday by a Fayette County grand jury on two counts each of child neglect resulting in death. The Fayette County Sheriff's Department said that Ashley Nicole Penson, 24, and Kyle Ralph Penson, 27, negligently used alcohol and/or marijuana before rolling over on the children during the night, causing the infants to suffocate.

The Hilltop couple was arrested June 11 following the release of autopsy reports from the State Medical Examiner’s Office.

Fayette Sheriff's Capt. Jim Sizemore said in March that the Pensons were extremely distraught at the deaths of their children, 3-month-old Remington and 1-year-old Jessie.

He reported that Ashley Penson awoke on the morning of March 11 and discovered that Remington was unresponsive.

Kyle Penson had gone to a neighbor’s house in order to call 911. While he was there, Ashley reportedly discovered that Jessie was also unresponsive. A second 911 call was placed.

Both children were taken to Plateau Medical Center, where they were pronounced dead.

Another child in the home was not injured.

Also, the grand jury returned an indictment of Thomas G. Carter Jr. on charges in an attack on an Oak Hill woman on the city's White Oak Rail Trail on June 14. Carter is charged with robbery in the first degree, kidnapping, sexual assault in the first degree and sexual abuse in the first degree.
